JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 32 of 2019 registered for the offences punishable under Sections 498A, 494, 341, 323, 379/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act, pending in the court of Judicial Magistrate, 1st Class, Samastipur.

FIR disclosed that petitioner-husband and other accused persons demanded Rs.2 lac as dowry and for nonfulfilment of the same assaulted the informant and ultimately ousted her from the matrimonial house.

Submission of learned counsel for the petitioner is that he is still ready to keep her with dignity and care. On the other hand, learned counsel appearing on behalf of opposite

Patna High Court CR. MISC. No.48817 of 2019(2) dt.06-08-2019 2/2 party No.2 has submitted that she is ready to reside with the petitioner though petitioner has married with another lady. Heard learned APP and perused the record, from which it appears that before the court below conciliation was made but that failed.

In view of above facts and circumstances, let petitioner surrender on 16.8.2019 before the court below and on surrender he shall be released on provisional bail for a period of 12 months and during that period learned court below shall watch their conduct and marital relationship by calling them in fourth week of every month and once the court is satisfied with their marital relationship and conduct, specially the conduct of the petitioner, his bail bonds shall be confirmed, otherwise the court below shall pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner. With the above observation, this application is disposed of.
