JUSTICE RAMESH KUMAR DATTA ORAL ORDER 23-11-2016 The alleged contemnors-opposite party Nos. 4 and 5 are present and additional show cause is filed on behalf of opposite party No.5, the present District Magistrate, Patna. Learned counsel for the petitioner seeks permission to withdraw the contempt application so that he may pursue the matter in a duly constituted proceedings, including a suit as may be advised.

I have also considered the statements made in the additional show cause of opposite party No.5 and do not consider it a fit case for continuing with the contempt proceedings initiated against him which are, accordingly, dropped.

Thus the contempt application is accordingly dismissed as not pressed leaving it open to the petitioner to take recourse to
