JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the daughter of the informant is languishing in jail since 24.02.2016 in a case registered for the offences punishable under Sections304B and 498a/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after eight months of the marriage for non-fulfillment of further demand of dowry of `1,00,000/- and gold ring. It is submitted by the learned counsel for the petitioner that the accusation against the petitioner is omnibus and general. Thrust of accusation is against the husband of the victim and on conclusion of investigation, final report (chargesheet) has been submitted under Sections 306 and 498A of the IPC, the said fact gets reflected from the impugned order also.
Patna High Court Cr.Misc. No.39471 of 2016 (2) dt.09-09-2016 2/2 Mr. J.N. Thakur, learned APP does not controvert this fact that final report (chargesheet) has been submitted under Sections 306 and 498A of the IPC.
Considering the fact that investigation has already concluded, final report (chargesheet) has been submitted under Sections 306 and 498A of the IPC and the petitioner being an old lady, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-III, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 214 of 2015.
