The petitioner is languishing in custody for the offence punishable under Sections 341, 323, 302/34/120B of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is one of the assailant of the deceased. Submission is that one of the eye witness said that the shot fired by the petitioner hit the neck whereas another eye witness at the belated stage said that it hit the chest. Petitioner has got criminal antecedent. Petitioner is in custody since 26.05.2020.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail in connection with Gopalpur (Rangra O.P.) P.S. Case No. 11 of 2020.
