JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 306/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. It is alleged that marriage of daughter of the informant was initiated with the petitioner but due to demand of dowry the daughter of the informant committed suicide.

It is submitted by learned counsel for the petitioner that neither there is anything on record to suggest that there was any demand initiated for marriage of the petitioner nor any proof with regard to the payment made. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.14020 of 2015 (2) dt.08-05-2015 2/2 that due to the demand made by the petitioner the daughter of the informant committed suicide.

Considering the fact that the victim committed suicide in the house of the informant and there is nothing on record to suggest that the demand was initiated or money was paid to the petitioner, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 41 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
