2. Petitioner seeks bail in Lalganj P.S. Case No. 242/2026, registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109, 132, 121, 121(2), 324(4), 352 and 351(3) of the Bharatiya Nyaya Sanhita, 2023.
3. In the F.I.R., it is alleged that on 21.05.2026 the police received a confidential information that one Abhinandan Kumar @ Basbariya is moving with a pistol with intention to commit occurrence. Thereafter, a team was constituted for his arrest. On 22.05.2026, the police caught a person who disclosed his name to be Abhinandan Kumar @ Basbariya. On interrogation by the police about the pistol, Abhinandan Kumar
Patna High Court CR. MISC. No.52242 of 2026(2) dt.29-07-2026 2/3 disclosed that the said pistol is with one Rahul Kumar. Thereafter, the police reached the house of said Rahul Kumar where several persons started abusing and assaulting the police team and damaged the police vehicle. When the police personnel started making video of this incident, the accused persons started pelting stones upon them due to which several police personnel sustained serious injuries. The Accused persons also forcibly released Abhinandan Kumar from the police custody. The local Chowkidar identified the persons who had committed the occurrence including the petitioner.
4. Learned counsel appearing on behalf of the petitioner stated that petitioner is neither a family member of Abhinandan Kumar nor the family member of Rahul Kumar. Petitioner has falsely been implicated in the present case and there is no specific allegation against the petitioner, rather there is general and omnibus allegation. Petitioner has a clean antecedent and he is in custody since 22.05.2026. It also appears from the impugned order that all the injuries are simple in nature. Therefore, the petitioner deserves regular bail.
5. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer for bail and stated that that the petitioner is a named accused and is a member of around 20-25
Patna High Court CR. MISC. No.52242 of 2026(2) dt.29-07-2026 3/3 persons who obstructed the police in discharging their official duty. Therefore, the petitioner does not deserve regular bail.

Considering the aforesaid facts and since the allegation levelled in the F.I.R. is not specific against the petitioner and it appears from the impugned order that all the injuries are simple in nature as well as considering the period of custody undergone by the petitioner and the fact that petitioner has no criminal antecedent, this Court is inclined to grant regular bail to the petitioner.
7. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Lalganj P.S. Case No. 242/2026.
