JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public prosecutor for the State. Petitioenr was granted privilege of anticipatory bail by this Court vide order dated 15.12.2014 passed in Cr. Misc. No.16313 of 2014 but petitioner could not surrender before the court below in time as he was in Military service and could not get leave.

In view of the aforesaid submissions, the petitioner is directed to surrender before the court of Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Paliganj P.S.case No. 31 of 2013 within six weeks from today and if petitioner does so, the concerned court shall proceed with the matter in the light of direction given by this Court vide order dated 15.12.2014 passed

Patna High Court Cr.Misc. No.29997 of 2015 (2) dt.19-08-2015 2/2 in Cr. Misc. No.16313 of 2014.

Accordingly, the order dated 15.12.2014 passed in Cr. Misc. No.16313 of 2014 stands modified to the above stated extent and in the aforesaid manner, this petition stands disposed of.
