JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section 307 and other minor Sections of the Indian Penal Code and 3/4/5 of BMMC Rule.
Petitioners are said to have attacked on police party and mercilessly assaulted them when police party tried to stop the vehicles of the petitioners.
Submission on behalf of the petitioners is that having more or less similar allegation, one co-accused Sadhu Yadav has already been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 3.5.2016 passed in
Patna High Court Cr.Misc. No.27077 of 2016 (4) dt.30-08-2016 2/2 Cr. Misc. No.15655 of 2016 and similarly, co-accused Pappu Yadav has been granted privilege of regular bail by a Co-ordinate Bench of this Court. Petitioners do not have any criminal antecedent and they are languishing in jail custody since 27.4.2016. The investigation against them has already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Nawada in connection with Rajauli P.S. Case No.245 of 2015.
