20-08-2016 Heard Sri Devendra Prasad Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 01-05-2016 in Pakribarawan P.S. Case No. 70 of 2016 registered for the offence under Sections 25(1-b)a, 26 & 35 of the Arms Act, 1959, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner is a professional driver and he was driving a vehicle, from which, one Pramod Singh, wanted in some case, was apprehended and from his possession, 10 live cartridges were recovered and from the vehicle in question, a bag was kept, in which, there were 80 cartridges. It was further submitted by learned counsel for the petitioner that petitioner was having no
Patna High Court Cr.Misc. No.34617 of 2016 (2) dt.20-08-2016 2/2 knowledge about such cartridges. By way of referring to seizure list, which is part of the F.I.R., he submits that from possession of the petitioner, only recovery of one mobile phone has been shown. It has been indicated that petitioner is having clean antecedent. In view of facts and circumstances, let the petitioner namely Mathura Paswan be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada (Sri N.K.Singh) in connection with Pakribarawan P.S. Case No. 70 of 2016.
