JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 This is an application for grant of anticipatory bail in connection with Dhoraiya P.S. Case No. 249 of 2018, disclosing offences under Sections 409 and 420 of the Indian Penal Code. In this case allegation of deposit of Rs.60 lacs, which has been allotted for construction of the school. Vide order dated 05.08.2019 a Co-ordinate Bench of this Court granted provisional bail to the petitioner with condition that he will deposit the total amount of Rs.2,97,963/- within three months.
Submission of learned counsel for the petitioner is that petitioner has deposited Rs.1,50,000/- but in the meantime, his mother died and later on, daughter of the petitioner was suffering from Dengu and as such, he does not deposit the rest of the amount, he is ready to deposit the same, if some

In such view of the matter, let the provisional bail granted to the petitioner, vide order dated 05.08.2019 is extended for a further period of two months. However, within the aforesaid period, the petitioner shall deposit the total amount as directed by the earlier order, the provisional bail granted to the petitioner, shall be confirmed by the learned court below, otherwise, the petitioner has to surrender and pray for regular bail.
