JUSTICE SUDHIR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 18-04-2017 The applicants herein, Anubha Singh, Sunita Kumari
Patna High Court LPA No.872 of 2014 (7) dt.18-04-2017 2/3 and Satish Kumar Lama were petitioners in Civil Writ Jurisdiction Case No. 10994 of 2013 have filed this appeal under Clause 10 of the Letters Patent being aggrieved by an order dated 07.03.2014 passed by learned Writ Court disposing of the writ petition in light of direction already issued by learned Writ Court on 07.03.2014 in C.W.J.C. No. 20739 of 2011. In the said writ petition being C.W.J.C. No. 20739 of 2011 which was filed by Sri Ram Singh and others, on 07.03.2014 the learned Writ Court directed the State Government to consider the claim of the petitioners on the basis of a fresh panel, which will be prepared in terms of the guidelines as well as the directives issued by this Court in C.W.J.C. No. 20739 of 2011.
It may be pertinent to note that challenging the order passed on 07.03.2014 in C.W.J.C. No. 20739 of 2011, the State Government preferred Letters Patent being L. P. A. No. 1108 of 2014 before a Division Bench of this Court. The said L.P.A. was dismissed and vide order dated 07.07.2015, a Division Bench of this Court had upheld the order of the learned Writ Court passed in C.W.J.C.No. 20739 of 2011 and we are informed that in accordance to direction issued in the original writ petition, a new panel has been prepared and given effect to that. That being so, once the order passed in C.W.J.C.No. 20739 of 2011 on 07.03.
Patna High Court LPA No.872 of 2014 (7) dt.18-04-2017 3/3 implemented being L.P.A. No. 1108 of 2014 has been dismissed by a Division Bench of this Court, we see no reason to make any indulgence into the matter.
The appeal also stands dismissed in view of the aforesaid facts.
