JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-10-2018 The petitioner seeks regular bail in connection with Garkha P.S. Case No. 360 of 2017, registered for offences punishable under Sections 394, 307, 120(B) of Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R is that while the informant was coming after withdrawing money from Grahak Sewa Kendra, three persons boarded on the motorcycle surrounded him and snatched away Rs. 2,81,000/- and other belongings and also fired on the informant causing injuries to him. Apart from that it appears that petitioner is an accused in ten more cases. It has been submitted on behalf of the petitioner that he is not named in the F.I.R., and save except the information of spy, there is absolutely nothing against the petitioner to show his
Patna High Court Cr.Misc. No.56030 of 2018 (2) dt.08-10-2018 involvement in the offence. Further submission is that though he is an accused in ten other cases but except in one case, he is on bail in all the cases and he has been in judicial custody since 07.04.2018.
Heard learned A.P.P. also.
Having heard both sides, considering the fact and circumstances of the case and also the criminal antecedents of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail. However, once the charge is framed and the trial is commenced, the Trial Court shall release the petitioner on bail to his own satisfaction.
