The petitioner seeks bail in anticipation of his arrest in connection with Sonepur P.S. Case No. 538 of 2020, dated 13.07.2020, instituted for the offence under Section 392 of the Indian Penal Code.

Though the name of the petitioner has transpired in the confession of an arrested accused person, but taking into account the fat that he was earlier also made accused in a case of similar nature, I am not inclined to grant him the privilege of anticipatory bail.

The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.

No.10780 of 2021(3) dt.10-02-2022 2/2 However, if he surrenders before the Court below and seeks bail, the Court below, after taking into account the afore-noted ground, namely, his being implicated in this case only on the basis of confession of a co-accused, shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
