Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 448, 354, 504, 506 of the Indian Penal Code and 3(I) (XI) of the S.C./S.T.(Prevention of Atrocities) Act. It is alleged that the petitioner pushed down the wife of the informant while she was coming home and abused by calling caste name.

It is submitted by the learned counsel for the petitioner that the First Information Report was registered on 24.07.2014 but the same reached to the court on 26.07.2014 which suggests that First Information Report was registered by ante dating. The informant has himself admitted that his wife has received simple injury and in the background of village

Patna High Court Cr.Misc. No.23377 of 2015 (2) dt.26-06-2015 dispute the accusation has been levelled.

It is submitted by the learned Special P.P. of the S.C/S.T. Act that the occurrence took place in public view. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Karakat P.S. Case No. 154 of 2014, pending in the court of learned Chief Judicial Magistrate, Rohtas at Sasaram.

With the above observation this application is disposed of.
