JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-12-2016 Instant petition has been filed for modification of conditions having been imposed while granting bail to the petitioner vide order dated 17.09.2016 under Cr. Misc. No.39900 of 2016.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Because of the fact that petitioner, repeatedly, after being released on bail, indulged in similar kind of activity and on account thereof, have been an accused in so many cases instituted under Excise Act and further, to prevent the petitioner from such activity henceforth, the condition has been imposed to deposit cash surety instead of bailors, which in the facts and circumstances of the case as well as considering the conduct of the petitioner does not warrant reconsideration.

Accordingly, instant petition lacks merit and is rejected. (Aditya Kumar Trivedi, J) Vikash/- U T
