JUSTICE SANJAY PRIYA ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sherghati P.S. Case No. 249 of 2018 instituted for the offence under Sections 461 and 379 of the Indian Penal Code.
Counsel for the petitioner submits that First Information Report is against unknown. There is no recovery from conscious possession of the petitioner. The name of petitioner has come in the confessional statement of co-accused Abu Hurera and Md. Ibrar. Counsel for the petitioner further submits that Md. Ibrar @ Ibrar @ Khesri Khan @ Khesari has already been granted bail by a coordinate Bench of this Court vide order dated 27.07.2018 passed in Cr. Misc. 45813 of 2018. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.53957 of 2018 (2) dt.03-10-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati P.S.
