====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 304B, 120B, 34 of the Indian Penal Code, 1860 and 3⁄4 of the D.P. Act.
3. Allegedly, all the accused persons including the petitioner are said to have killed the informant's daughter due to non-fulfillment of dowry demand.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is mother-in-law of the deceased. No such
Patna High Court CR. MISC. No.55453 of 2023(2) dt.09-10-2023 2/3 occurrence as alleged ever took place. She has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and based on concocted facts. She has been living separately from the deceased and her husband. It is further submitted that the husband of the deceased is in custody, as mentioned in Para 11 of the bail application. Similarly situated co-accused persons have been enlarged on bail by a co-ordinate bench of this court vide order dated 06.07.2023 passed in Cr. Misc. No. 22880 of 2023. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposes the prayer for bail.
6. Having regard to the facts and circumstances of the case, as the husband of the deceased is in custody, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kotwa P.S. Case No. 368 of 2022,
