JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioners are languishing in custody since 20.03.2015 in connection with Laheriasarai P.S. Case No. 147 of 2010 for the offences instituted under Sections 307, 326 and 120(B)/34 of the I.P.C.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that the informant, namely, Shibgatullah @ Dabbu alongwith his neighbour Salauddin went to Mohalla-Shabsupan by one Motorcycle on 18.4.2010 at 9.00 A.M. in the morning to take part in Panchayati which was scheduled to be held between Fakira Mahaseth and Ram Babu Mahaseth for land dispute. It is further alleged that when the informant reached at the door of Fakira Mahaseth, he was fired by

Patna High Court Cr.Misc. No.24341 of 2015 (3) dt.19-08-2015 2/2 six persons and informant and his neighbour Salauddin stained fire injuries on their person and they were brought to D.M.C.H. where the fardbeyan of the informant was recorded.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.03.2015 and the charge sheet has been submitted in the present case. It is further submitted that there is no specific allegation against the petitioners for causing injury upon the victim. It is further submitted that the petitioners may be released after completion of six months in custody from 20.03.2015.

On behalf of the State it has been submitted that the petitioner no. 1 is named in the F.I.R. and petitioner no. 2 is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail after completion of six months in custody from 20.03.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Laheriasarai at Darbhanga, in connection with Laheriasarai P.S. Case No. 147 of 2010.
