01-07-2015 Heard Sri Rajani Kant Mishra, learned counsel for the petitioner, learned A.C. to Standing Counsel - 15, Sri Prasoon Sinha, learned counsel who has appeared on behalf of officials of B.R.E.D.A. as well as Sri Gyan Shankar, learned counsel for Bihar State Sugar Corporation.

The present petition has been filed with a prayer to restore M.J.C. No. 2408 of 2011, which stood dismissed due to non-compliance of peremptory order dated 24-11-2014. It was submitted by learned counsel for the petitioner that as per peremptory order, reply to the show cause was to be filed by 07-12-2014, however; after expiry of two days of the peremptory time, same was filed.

In view of the facts & circumstances, the restoration petition is allowed.

Patna High Court MJC No.1118 of 2015 (2) dt.01-07-2015 2/2 Let M.J.C. No. 2408 of 2011 be restored to its original file.
