====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-09-2021 Heard Ms. Kumari Sudha Sinha, learned counsel for the petitioner and Mr. Binod Kumar No. 3, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Puraini P.S. Case No. 176 of 2019 registered for the offences punishable under Sections 376, 511, 341, 323, 504, 506 of the Indian Penal Code-1860, Sections 8/12 of POCSO Act and Section 37(b)(c) of Bihar Excise Act.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected on merit by this Court vide order dated 14.9.2020 passed in Cr. Misc. 19387 of 2020. This Court by an order dated 11.8.2021 had called

Patna High Court CR. MISC. No.11634 of 2021(4) dt.29-09-2021 2/2 for a report from the trial court regarding stage of trial and in pursuance thereof, the report of learned Additional Sessions Judge-VI-cum-Special Judge, (POCSO), Madhepura, is on record and from perusal of the same, it appears that the learned Trial Court has given the estimated time for completion of the trial within 3-4 months.

In view of the nature of allegation, I am not inclined to grant regular bail to the petitioner at this stage. The prayer for regular bail of the petitioner stands rejected.

However, the petitioner may renew his prayer for bail after four months if the trial does not conclude. The explanation furnished by the Additional Sessions Judge-VI-cum Special Judge (POCSO), Madhepura, vide letter No. 65 dated 21.9.2021 is accepted.
