2. The petitioner seeks regular bail in connection with Alauli P.S. Case No. 138 of 2025 registered for the offence under Section(s) 137(2) and 140(3) of the Bharatiya Nyaya Sanhita, 2023 and subsequently, Section 103(1), 217, 248(b), 238(a), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 was added.

3. As per the prosecution case, the petitioner is accused of kidnapping and killing the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 15.04.2025. He further submits that from the records it appears that the deceased had committed

Patna High Court CR. MISC. No.50626 of 2025(3) dt.15-10-2025 2/2 suicide and the petitioner on the asking of the mother of the deceased had tried to dispose of the body of the deceased.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria/concerned Court below in connection with Alauli P.S. Case No. 138 of 2025.
