JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-09-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner namely Bikky Bhagat is in custody since 18.06.2016 in Tatarpur (University) P.S. Case No.77 of 2016, G.R. No.1902 of 2016 under Sections 457, 380 of the Indian Penal Code.

The allegation is that unknown persons committed theft in the house of the informant and took away cash of Rs.50,000, laptop, jewellery and other articles.

According to the learned counsel for the petitioner, from the possession of co-accused, Ritesh Kumar, some articles such as A.T.M., Adhar Card, PAN Card etc. have been recovered and in his confessional statement, he named this petitioner. Except this,

Patna High Court Cr.Misc. No.39009 of 2016 (2) dt.17-09-2016 nothing is there against the petitioner. The petitioner himself surrendered before the Court below on 18.06.2016. Considering the above facts and circumstances of the case, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned A.C.J.M., Bhagalpur in connection with Tatarpur (University) P.S.
