JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code. It is alleged that Rs. 4 lacs were paid by the informant to the petitioners for transfer of 62.5 decimals of land but only 45 decimals of land were transferred.
It is submitted by learned counsel for the petitioners that the petitioners are ready to transfer the rest of the land. A statement to that effect has been made in para 16 of the petition. Considering the aforesaid facts, let the above named petitioners be released on provisional anticipatory bail for six months, in the event of arrest or surrender before the learned Court
Patna High Court Cr.Misc. No.9537 of 2015 (2) dt.11-05-2015 2/2 below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Jehanabad in connection with Kaler P.S. Case No. 47 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The provisional bail of the petitioners will be confirmed on transfer of the rest of the land in favour of the informant.
