The petitioner apprehends his arrest in Ahiyapur P.S. Case No. 573 of 2014, registered for the offences punishable under Section 376 and other Sections of the Indian Penal Code. The informant made allegation that the petitioner on the pretext of marrying with her established physical relation with the prosecutrix, but later on the petitioner refused to marry. Learned counsel for the petitioner submits that no date of occurrence is mentioned. The prosecutrix was not examined by any doctor.

Considering the facts aforesaid and the fact that the prosecutrix herself alleged that the petitioner after duping her established physical relations on the pretext of marrying her, I am not inclined to enlarge the petitioner above named on anticipatory

Patna High Court Cr.Misc. No.14091 of 2015 (2) dt.11-05-2015 2/2 bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
