JUSTICE RAVI RANJAN ORAL ORDER 11-05-2015 Petitioner is aggrieved by the rejection of his technical bid vide Annexure-7 which discloses that he is disqualified under CMBD Clause ITB 4.7. Learned counsel submits that he has not suppressed anything and in view of the complaint made by one Abhay Kumar, he has been disqualified. He submits that he approached the authority itself regarding that but no decision has been taken on his representation dated 02.02.2015.

In above view of the matter, this writ application is being disposed of with a direction to the Chief Engineer, i.e.,

Patna High Court CWJC No.4701 of 2015 (2) dt.11-05-2015 2/2 respondent no.2 to take a decision upon the representation dated 02.02.2015 on its own merit and in accordance with law. It is expected that such decision would be taken before any agreement being signed with any person regarding the works contract, if the same has already not been done and such decision should be communicated to the petitioner.
