This application is for grant of regular bail in connection with Raghunathpur P.S.Case No.209 of 2017 for the offences under Section 379 of the Indian Penal Code. Allegation against the petitioner is that as per FIR is of theft of the motorcycle of the informant. It further appears that later on the stolen motorcycle was recovered from the possession of the petitioner and for that another case has been lodged. Submission of the learned counsel for the petitioner is that in this case there is nothing against the petitioner. He is in custody since 8.2.2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.61755 of 2018 (2) dt.11-10-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge is framed, the petitioner may renew his prayer for bail.

With the aforesaid observation, this application is disposed of.
