JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2016 Heard Sri Alok Kumar, learned counsel, who was assisted by Sri Shivanand Singh, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody since 17.07.2016 in Gopalpur P.S. Case No.62/2016 registered for the offence under Sections 414, 272, 273/34 of the Indian Penal Code and Sections 47, 57 of the Bihar Excise( Amendment ) Act, 2016., have prayed for grant of bail.

By way of referring to the statement made in paragraph-3 of the petition, it was submitted by learned counsel for the petitioners that the petitioners are having clean antecedent

Patna High Court Cr.Misc. No.40921 of 2016 (2) dt.06-10-2016 2/2 and on false accusation of recovery of 13 Liters of Nepali Liquor, the petitioners have been made accused in the present case. Keeping in view the nature of accusation, period of custody and clean antecedent of the petitioners, let both the aforesaid petitioners, namely, (i) Narayan Kumar Gupta and (ii) Subhash Kumar, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettah in connection with Gopalpur P.S. Case No.62/2016.
