Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

The minor daughter of the informant went missing. During search the informant came to know that victim was seen in the company of the petitioner, co-accused Prince Kumar and Sandeep Kumar. The victim in her 164 Cr.P.C statement though recorded her age as 15 years and Court assessed as such but she has stated that she was abducted by Prince Kumar and 3-4 unknown persons.

It is submitted by learned counsel for the petitioner that victim's family is known to the petitioner and there was no occasion for the victim not to name the petitioner

Patna High Court Cr.Misc. No.23061 of 2015 (2) dt.13-07-2015 2/2 when she gave her 164 Cr.P.C statement after consulting with the informant who named the petitioner in the First Information Report. Moreover co-accused Sandeep Kumar has been granted bail vide Cr. Misc. No. 43146 of 2014. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the 164 Cr.P.C statement of the victim, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Jhajha P.S. Case No. 19 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
