JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 467, 468, 474, 420 and 120(B) of the I.P.C.

Accusation is that the petitioner was caught while fleeing away from the place of occurrence and one A.T.M. card and two mobiles were recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.8.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been

Patna High Court Cr.Misc. No.51453 of 2016 (2) dt.15-12-2016 2/2 made accused due to mistake of fact. As per the allegation, different ATM cards and different account numbers are said to have been found in the car of the petitioner. The petitioner claims the said ATM cards to be his own.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif at Nalanda in connection with Bihar P.S. case No.327 of 2016.
