JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is apprehending his arrest in connection with complaint case No. 83 C/2014 for the offence under section 498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that complainant was married to petitioner on 24.05.2013 and at that time Rs. 1,50,000/- , gold chain and ring were given as dowry. After some days of stay in her matrimonial home the accused persons started pressurizing her to fetch Rs. one lac and a motor cycle from her parents thereafter her mother and brother gave Rs. 80,000/- to the petitioner but the accused persons were not satisfied and they started torturing her thereafter she was taken to her parental home

Patna High Court Cr.Misc. No.23623 of 2015 (2) dt.06-07-2015 2/2 by her brother. But after some days the petitioner came and took her with giving assurance not to torture her but after some time the accused persons again started abusing her.

It is submitted on behalf of the petitioner that petitioner is ready to keep the complainant with all respect and dignity but the same is not acceptable to the complainant. It is further submitted that petitioner is ready to deposit an amount of Rs. 2000/- each month in the court below which shall be released in favour of the complainant.

Considering the aforesaid facts, it is directed that petitioner shall deposit a sum of Rs. 2000/- each month in the court below which shall be released in favour of the complainant. With the said condition, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Munger in connection with complaint case No. 83 C/2014, subject to condition as laid down under section 438(2) of the Cr. P.C. (Sudhir Singh, J) BKS/- U T
