NILU AGRAWAL ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody since 21.08.2016 in connection with Tariyani P.S. Case No. 34/16 for offences punishable under Section 387 of the Indian Penal Code.

The allegation against the petitioner is of demand of ransom of Rs. 2 lakhs from the informant. It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the First Information Report and has been remanded in another case i.e. Tariyani P.S. Case No. 31/15 on his inculpatory self extra judicial confessional statement. It is submitted that he has no

No.52331 of 2016 (2) dt.16-12-2016 2/3 connection with the mobile used for demand of ransom and charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence. It is further submitted that another co-accused, on similar allegation, has since been granted the privilege of bail by a Coordinate Bench of this Court in Cr. Misc. No. 51034 of 2016 on 28.11.2016.

However, learned APP for the State opposes the prayer for bail.

Be that as it may, since charge-sheet has already been submitted and other co-accused, on similar allegation, has since been granted the privilege of bail, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 34/16, G.R. No. 136/16.
