JUSTICE SUDHIR SINGH ORAL ORDER 18-09-2018 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case for the offence registered under Sections 304(B), 302, 201 and 120(B)/34 of the IPC.

The prosecution story, in brief, is that the daughter of the informant Priyanka Kumari was married with Ravi Kumar @ Sanjeev Kumar on 10.06.2014. After 15 days of marriage, his sonin-law and his other family members started demanding Rs. 10,00,000/- as dowry. He has given Rs. 4,00,000/- and rest amount remains to pay. On 01.05.2015, an information was given by Kaushal Kishore that both daughter of the informant drowned in the Ganga river. After two days, dead body of his both daughters was recovered by N.D.R.F. Team and sign of brutally beaten and apprehension of acid attack were found and after postmortem, bodies were handed over to the informant. It is also alleged that both the daughters were killed for demand of dowry.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is cousin brother of husband of the deceased. He is separate in mess and property from the husband of the deceased. The petitioner has got no concern with the alleged occurrence.

On behalf of the learned counsels for the State and informant, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.57635 of 2018 (2) dt.18-09-2018 3/3 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-cum-Sub Judge-II, Barh, Patna, in connection with Salimpur P.S. Case No. 125/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
