The petitioner apprehends his arrest in connection with Karjain P.S. Case No. 84 of 2014 registered for the offences punishable under Sections 307, 324, 147, 148, 149, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on account of the fact that earlier there was a dispute between the parties with respect to the land, in question. It is further submitted that the injury sustained by the injured is not attributed to the petitioner as in the earlier case which was registered against the petitioner with false allegations, which ultimately resulted into acquittal of the petitioner. Patna High Court Cr.Misc. No.25264 of 2015 (3) dt.30-07-2015 in the earlier case, the petitioner has brought out this case only with a view to robe him further in connection with the said land dispute.

Having perused the materials on record and considering the submissions of the parties as also the fact the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Birpur, District Supaul in connection with Karjain P.S. Case No. 84 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
