JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 This petition has been filed on behalf of the petitioner to grant him bail in connection with Motihari Muffasil P.S.Case No. 106 of 2016, which has been registered under section 307 and various other sections of the Indian Penal Code as well as section 3(i) (x) of the SC/ST Prevention of Atrocities Act, pending in the court of Chief Judicial Magistrate, Motihari, East Champaran Therefore, in my view, Appeal shall lie against the impugned order.

In view of the aforesaid facts as well as on the prayer of learned counsel for the petitioner, this petition is dismissed as withdrawn.

However, petitioner shall be at liberty to challenge the impugned order before the appropriate forum.
