Petitioners seek bail in Nokha P.S. Case No.82 of 2018 instituted for the offence under Section(s) 147, 148, 149, 448, 341, 323, 324, 325, 307 and 302 Indian Penal Code. Counsel for the petitioners submits that there is general allegation against the petitioners. They are in custody since 05.05.2018 and 08.05.2018 respectively. In the written report, there is specific allegation against co-accused, Vijay Ram, of assaulting the informant. Similarly, allegation has been leveled against Babulal Ram of assaulting Bhaisur (brother-in-law) of the informant by Gandasa. Mahendra Ram and Kamlesh Ram are alleged to have assaulted
Patna High Court Cr.Misc. No.56494 of 2018 (2) dt.04-10-2018 2/2 on the head of husband of the informant.
It has been submitted that the other co-accused has already been granted bail by co-ordinate Bench of this Court vide order dated 21.08.2018 passed in Cr. Misc. No.39202 of 2018. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Nokha P.S. Case No.82 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
