Mr.Ashok Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2022 At the outset, learned counsel for petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner nos. 2 and 3.

Permission is granted. The anticipatory bail application with respect to petitioner nos. 2 and 3 is dismissed as withdrawn.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner no. 1 apprehends his arrest in a registered for the offences punishable under Sections 307, 504/34 of the Indian Penal Code and section 27 of the Arms Act.

Patna High Court CR. MISC. No.52616 of 2022(2) dt.20-12-2022 2/2 As per the prosecution case, petitioner no. 1 and his both sons fired upon the informant causing firearm injury in his chest.

It is submitted that there is general and omnibus allegation of firing. Three persons are alleged to have fired, but only one firearm injury was found on the person of injured. Injury report is of private hospital which can not be relied. Case and counter case. Petitioner claims clean antecedent. Considering the facts aforesaid, Ramnath Sahni petitioner no. 1 in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S. Case No. 65 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
