JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.

Allegation is that unknown miscreants snatched Rs.1000/- and the motorcycle from informant.

It has been submitted on behalf of petitioner that he is in custody since 9.3.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. The name of petitioner was disclosed by the co-accused on the basis of which he has been made accused in the present case. There is no recovery of any incriminating article from the possession of the petitioner. Petitioner has falsely been implicated in the present case. It is further submitted that petitioner may be released after completion of one year in custody, i.e., from 9.3.2016.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R. and he has got criminal antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of one

Patna High Court Cr.Misc. No.44351 of 2016 (2) dt.17-10-2016 2/2 year in custody, i.e., from 9.3.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case no. 1012 of 2015.
