JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 28.06.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341 and 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of the dowry demand. The complainant has also alleged that the petitioner has illicit relationship with another lady and attempt was made to cause burn injury.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant. The petitioner filed Complaint Case No. 2543C of 2012 on 06.12.2012

Patna High Court Cr.Misc. No.41782 of 2016 (2) dt.23-09-2016 2/2 when the complainant after committing theft in the house of the petitioner went to her parent's house without informing the petitioner and thereafter the present complaint has been filed on 28.08.2012.

Considering the nature of accusation and the complaint case filed by the petitioner at earlier point of time, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Nalanda at Bihar Sharif in connection with Complaint Case No. 1081C of 2012.
