The petitioner seeks bail in connection with Amnour P.S. Case No. 152 of 2016 registered for the offences punishable under Sections 188 and 420/34 of the Indian Penal Code and Sections 47, 47(a) and 48(2) of the Bihar Excise (Amendment) Act, 2016.
Prosecution case is that on secret information the police party recovered 909 liters of English wine from a pick-up van and F.I.R. has been lodged against the vehicle and unknown driver.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.49798 of 2016 (2) dt.13-12-2016 2/2 the petitioner has got no criminal antecedent. The petitioner has been made accused only on mere suspicion. He has been false implicated in the case only on the confessional statement of one Shailesh Prasad. He is languishing in custody since 24.10.2016. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Amnour P.S. Case No. 152 of 2016.
