Mr.Md. Matloob Rab ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks bail in connection with Phulwaria P.S. Case No. 76 of 2017, registered for the offences punishable under Sections 420, 408, 379 and 406 of the Indian Penal Code. Petitioner happens to be driver of the informant and was carrying 20,000 litres of milk valued at Rs.6,29,000/- and allegation is that he remove the milk and put water in the tanker and after parking the vehicle he fled away. Apart from that, he is accused in six other cases also.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for more than nine months and charge has already been framed in this case.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail of the petitioner.

No.50953 of 2019(6) dt.20-02-2020 2/2 In view of above facts and circumstances and considering the period of custody and charge has been framed, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Raghubir Prasad, Judicial Magistrate, 1st Class, Begusarai, in connection with Phulwaria P.S. Case No. 76 of 2017 on the condition that he has to appear before the trial court as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bonds.
