JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given farsa blow causing injury on the head of the informant. Annexure-2 to the petition goes to show that the informant sustained grievous injury on her parietal scalp.

Submission on behalf of the petitioner is that according to the prosecution case, the alleged occurrence took place on 30.10.2015 but the informant filed complaint case on 04.12.2015 and on the basis of the complaint case, the present case was lodged and the aforesaid delay in lodging the first information report has not properly been explained. Moreover, petitioner is in jail custody since 17.06.2016 without having any criminal antecedent.

Patna High Court Cr.Misc. No.39213 of 2016 (2) dt.26-09-2016 2/2 It would appear from perusal of the first information report that the alleged occurrence took place on account of land dispute and petitioner happens to be full brother of informant's husband.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Katihar in connection with Amdabad P.S.Case No. 59 of 2016.
