2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act 2016.
3 . It is alleged that 91.200 liters of Nepali liquor was recovered from hut in question situated at Gate No. 1 of Bela Industrial Area .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The hut in question does not belongs to this petitioner. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid

5. Learned counsel for the State opposes the bail petition.
6. Considering the fact that hut in question does not belongs to this petitioner, clean antecedent of petitioner and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge - II (Excise Act ), Darbhanga in connection with LNMU Police Station Case No. 301 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
