JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the First Information Report and it appears from the impugned order that the name of the petitioner came in confessional statement of co-accused and after that the petitioner was remanded in the present case. Submission on behalf of the petitioner is that coaccused Md. Shahrukh Khan in whose confessional statement, the name of the petitioner came in this case has already been granted privilege of bail.

No.36772 of 2016 (2) dt.31-08-2016 2/2 Taking note of the aforesaid facts as well as this aspect of the matter that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of IVth Additional Sessions Judge, Bhagalpur in connection with Industrial P.S. Case No. 114 of 2015, S.T. No. 470 of 2016.
