Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 379 of the Indian Penal Code.

The prosecution case as per F.I.R is that one

Patna High Court CR. MISC. No.7956 of 2021(3) dt.08-12-2021 2/3 Mani Shankar Kumar, Secretary of Chandrashekhar Azad Gramin Vikash Sewa Sansthan was selected for imparting computer training in 21 schools for a consideration amount of Rs. 6,00,000/-. It is alleged that he embezzled the amount without imparting training after submitting photocopy of the certificate issued by the Headmasters of the schools.

It is submitted by learned counsel for the petitioner that petitioner has been implicated along with 21 Headmasters. The petitioner has already retired from the service and is ill. The thrust of accusation is against Mani Shankar Kumar and he has not received a single penny from Mani Shankar Kumar.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the
