JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,302,384 and 386 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the accused persons came including the petitioners variously armed and demanded extortion as the informant has purchased new tractor. In the meantime, co accused Mahesh Choudhary ordered for taking away the mare of the informant then petitioner no. 1 started taking away the mare of the informant which was protested by the younger brother of the informant, thereafter co accused Mahesh Choudhary ordered to

Patna High Court Cr.Misc. No.22561 of 2015 (2) dt.22-05-2015 2/2 kill whereupon co accused Arvind Choudhary fired with the rifle on the younger brother of the informant namely Dinesh Yadav. Thereafter, all the accused persons escaped from the scene. It is submitted by the learned counsel for the petitioners that the accusation of firing is specific against co accused Arvind Choudhary. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Salkhua P.S. Case No. 84 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
