JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The Petitioners seek regular bail in connection with Karamdey P.S.Case No. 31 of 2016, registered for offences punishable under Sections 302/34 of the Indian Penal Code. As per allegation against the petitioners is of abusing the husband of the informant and on protest, the petitioners locked the door and started pelting stones and bricks on the head of the husband of the informant, due to that he succumbed to injury. Submission of the learned counsel for the petitioners is that the petitioners have been falsely been implicated in this case and the husband of the informant died due to ailment and informant presumed that mother of accused is " Dain" and she committed black magic on the deceased, which will appear from
Patna High Court Cr.Misc. No.57945 of 2018 (2) dt.28-09-2018 2/2 paras 26, 44 and 45 of the case diary and the petitioners are in custody since 12.06.2018 and 15.06.2018 respectively. Heard learned A.P.P also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) each with two sureties of the like amount each to the satisfaction of Shri Radhe Shyam, learned Judicial Magistrate, 1st class, Sheikhpura in connection with Karandey P.S.Case No. 31 of 2016, subject to the following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
ii) The petitioners will not induce any witness or tamper with the evidence.
iii ) It is made clear that if petitioners found involved in any of the like offences, in future, prosecution is free to move for cancellation of their bail bonds. (Vinod Kumar Sinha, J) Sudha/- U T
