JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bounsi P.S. Case No. 24 of 2017 instituted for the offence under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of Arms Act.

Petitioner is husband of the informant.

In the written report it is alleged that petitioner made firing upon the informant but she managed to save herself. Counsel for the petitioner submits that informant has lodged another case vide Banka Mahila P.S. Case No. 1 of 2015 for the offence under Section 498(A) of the Indian Penal Code in which the petitioner is on bail. The allegation against the petitioner is of making firing but it did not hit anybody. Petitioner is in custody in the instant case since

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Banka, in connection with Bounsi P.S.
