1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420, 341, 323, 467, 468 and 120(B), 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant. It is further submitted that similarly situated co-accused had come to this court seeking anticipatory bail of Ramadhar Singh by filing Cr. Misc. No.29789/2022 but the same was allowed by an order dated 16.11.2022. It is further submitted that petitioner also like Ramadhar Singh has neither purchased nor sold the land of the informant nor he is a witness on any of the sale deed purported
Patna High Court CR. MISC. No.54997 of 2024(2) dt.06-09-2024 2/2 to have been executed for selling the land of the father of the informant by resorting to forgery. It is next submitted that even a T.S. No.74/2020 is pending in the Court of learned Sub-JudgeI, Aurangabad in which even petitioner is a defendant. It is further submitted that the case of the petitioner is akin to the case of Ramadhar.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Aurangabad Muffasil P.S. Case No.56/2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
