The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 109 and 34 of the Indian Penal Code.
As per the prosecution case, in a fight between two families it is stated that the petitioner assaulted the mother of the informant leading to grievous injuries.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There was case and counter case between the parties, the FIR of the counter case lodged by the son of the petitioner having been brought on record as Annexure-2 to the petition. Having heard learned counsel for the parties and taking into consideration that there is case and counter case between the parties, the petitioner having remained in custody for over 9 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Triveniganj P.S. Case no. 223 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Supaul.
