2. The petitioners are in custody since 08.08.2016 in connection with Tr. No. 688 of 2016 (G.R. No. 1126/04) arising out of Ara Nagar P.S. Case No. 144 of 2004 for the offences alleged under Sections 25(1-B)a, 26 and 35 of the Arms Act.
3. It is submitted that petitioners had been granted bail earlier and had been well represented before the learned Court below. However, counsel for the petitioners failed to appear in the Court when the case was called out, as a result of which bail bonds of the petitioners were cancelled by the concerned Court on 08.01.2009 and thereafter process was issued under Section 83 Cr.P.C. by order dated 09.05.2016, which has led the petitioners to file the present bail petition.
4. Considering that the petitioners failed to honour the
Patna High Court Cr.Misc. No.41040 of 2016 (2) dt.29-09-2016 2/2 terms of the bail bonds and no satisfactory reason has been stated for delay of several years since the bail bonds were cancelled on 08.01.2009 for taking remedial steps, this Court is not inclined to grant the privilege of bail to the petitioners. Bail petition stands dismissed.
